How to get custody of two children?

My boyfriend has two children that the biological mother has live with her so she gets child support. they are 14 and 11. My boyfriend pays out $800.00 a month to this lady and she doesnt spend any of it on the children. she uses all of it for rent and to buy drugs. this lady does weed everyday and to the point where she cant even cook dinner for her own children because she is too stoned. Both children have told the mother that they dont want to live with her because my boyfriend takes better care of them, but she wont let them leave.

we are going to be moving to hawaii and would like to take the children with us because living with their mother is detrimental to their health. if we were to have the children come visit us and never sent the children back( the mother doesnt have legal custody of the children) would that be considered kidnapping or illegal? How hard is it to get custody of children that are being raised by a pothead? shouldnt that be an automatic thing to get them out of that house?

If he pays child support then I persume it is court ordered. Therefore fore she is the custodial parent. Taking them to Hawaii and not bringing them back is kidnapping-period.



Step 1-get a lawyer. You want the meanest, dirtiest SOB in town.



Step 2-get a cell phone. Show up to see the kids unannounced, mainly on Friday or Saturday nights. You were in the neighborhood ans wanted to see if they wanted to run out for a milkshake for a few minutes. Do this till you cather her royally stoned. At this point you call the cops and say you are scared to take them home, but you are under a court order to do so. Meet them at the house and they will see for themselves and file a report..Then call Child Protective Services. 2 or 3 times of this and getting the kids is a snap-IF you are truly a better parent and can give them a better home.How to get custody of two children?
It is illegal for you to take the children to Hawaii and not return them to their mother. Don't even think about going that route.



Consult with an attorney! There are a lot of dynamics involved in your particular case that only an attorney can evaluate and help you with.
FIRST OF ALL YOU WOULD HAVE TO FILE A PETITION IN THE COURT FOR CUSTODY. THEN YOU WOULD GET YOUR DAY IN COURT. THEN YOU WOULD HAVE TO PROVE TO THE COURT THAT THE MOTHER IS NOT FIT TO TAKE CARE OF THE TWO KIDS.

THEN THE JUDGE BECAUSE OF THE CHILDRENS AGE WOULD PROBALY ASK THEM WHAT THEY THINK. AND EVEN THEN I DOUBT THAT YOUR BOYFRIEND WOULD GET FULL CUSTODY EXPECIALLY IF YOU ARE MOVING OUT OF STATE.



FYI: IF THE MONEY THAT SHE GETS FROM CHILD SUPPORT IS BEING USED FOR RENT THEN THERE SHOULDNT ACTUALLY BE ANYTHING TO ***** ABOUT CAUSE ITS PUTTING A ROOF OVER THERE HEAD.
If there is no formal custody order in place that would be a tough call to get you prosecuted but I wouldn't test it.



As far as Pro Bono goes that is a lawyer that represents you for free and in this case I doubt you find one.



You have a strong case based on you description to get full custody and I would do what ever I could to get money for a lawyer. If she is messed up like you say she may just give them up, never know.

EDIT: If this was a man and you were a woman and this was the situation the posts would be ';what a loser'; or ';dead beat';. I guess its hard for people to accept that woman can be bad parents too.



an as far as kidnapping. you cant kidnap your own kids if there isn't a COURT order in place. She could take off right now and not have to tell you anything and NOTHING would be done to her. However, since the kids are in her possession its a gray area so I wouldn't try it.
